What Can (Legal) Debt Collectors in Singapore Actually DO TO YOU.....and what they Can't

Code of Conduct set by the Credit Collection Association of Singapore are in theory a set of rules that debt agencies must abide by. However as Yahoo Finance puts it, this isn't the same as being bound by law. They report that while many have called for laws to govern debt collecting, there currently have been no rush from the local law makers in setting any.

Debt Collectors can act as Mediators between YOU and your Creditor

Debt Collectors may sound like legal Ah Longs which may bring to mind the Ah longs of old who hunt their debtors down with parang and sticks but in Singapore behaving like a gangster can land them in prison. The whole idea is basically to recover the debts you owe. No one would risk prison for something which to them is purely business.

Where possible the debt collectors would be mostly willing to accept any installment plan that you propose. If you appear reasonable and show willingness to make good your debts, the code that governs their agencies do request that they accept your installment plan, provided you prove that you really have no means to settle the debt in full.

​Debt Collectors are allowed to speak to your family and friends

Speaking to your family and friends does not constitute as an offence and anything that others can legally do (if money is owed) so can the debt collector. They can drop by your office to speak with you or even call your home to inquire about your whereabouts.

This means that they can inform anyone who picks the call that you owe money and they are contacting you in reference to your loans.

The Debt collectors however must respect the Protection from harassment act

- Threaten You with physical harm or even harm your pet
- Follow you around after work
- Loiter near your house
- Distribute photos of you which may cause humiliation
- Brandish a weapon
- Cause you harm or your property
- Knock your phone off your hands if you are recording them
- Spray notices on walls to humiliate you
- Vandalize anything you or your love ones own
- Vandalize anything for that matter
- Cannot impersonate government bodies (Inform the police if you receive letters with Government letterheads about your debts as the Government does not get involved with such matters)

What can YOU DO if they do anything illegal to you....

Like any private citizen they have to live within the bounds of the law. They have just as much rights as any man on the street whom you may owe any money too.

A Final word of advice...

Avoid borrowing altogether. If you know you can never have the means to repay....just do without the loan if possible. Find any other solution before resorting to any loans. Best is always to be prudent and avoid any borrowing all your life. Be financially free or aim for it wherever it is possible for you under your circumstances.
